Within these terms and conditions “Devices” mean your EV, EVSE, Battery, or any other hardware (excluding hot water managed through smart meter dynamic load control) that you give Octopus Energy permission to control or manage.
By signing up to the Intelligent Octopus (IO) you agree to these terms in addition to the Octopus general terms & conditions and privacy policy.
You must ensure that any Devices you ask Octopus Energy to manage are safe and meet all relevant electrical standards and regulations.
This service is available for managing Devices you register in your app on your Octopus Energy customer account.
For EV and EVSEs, charging will be managed when your EV is at the location linked to this customer account. All of your EV charging at the location of the ICP linked to this customer account must be managed through this service.
This is a beta trial. This means some things may not work the first time or may break and that, on occasion, wifi or communication issues can prevent things from working. By agreeing to participate in this trial you accept that there is a risk of us not being able to perfectly optimise your Devices, and that power consumption may occasionally happen at suboptimal times.
If you notice any issues with your Devices please contact us immediately. Octopus will take reasonable steps to seek to resolve the problem as quickly as possible. You will always be able to stop participating in the trial.
Octopus will gather data about your usage, technology characteristics (e.g. model, size, power consumption), operating preferences, any actions you take and how your Devices perform. We will use this information to help us refine our service and we may also share this information:
i. with anyone as aggregated anonymised insights. For example: a report showing the average kWh contributed to peak demand by export from all Intelligent Octopus controlled batteries in the Canterbury region during June 2026.
ii. with specified organisations, where you have opted in to a trial or offer that requires ICP level data to measure and fulfil the obligations of the trial or offer. We will tell you who we are sharing this data with as part of your sign-up to the programme.
For example, a monthly report to the local network company showing the half hourly charging and discharging on your Intelligent Octopus controlled battery so the network can calculate your eligibility for and the amount of credit to be paid to you.
Octopus accepts no liability for wear of your Devices. Our liability to you shall be as set out in our General Terms and Conditions.
We may stop providing the trial service, or may terminate your use of it at any time. We will tell you as soon as practical if we intend to stop the trial service.
